On November 3, 2015, the U.S. House of Representatives Energy & Commerce Committee’s Subcommittee on Health held a hearing entitled “Examining Legislation to Improve Medicare and Medicaid.” Witnesses were: (i) The Honorable Lynn Jenkins, Member, U.S. House of Representatives; (ii) Katherine Iritani, Director, Health Care, Government Accountability Office; and (iii) Anne Schwartz, PhD, Executive Director, Medicaid and CHIP Payment and Access Commission. Ms. Iritani described a GAO report released during the hearing entitled “Improving Transparency and Accountability of Supplemental Payments and State Financing Methods,” which is available at http://www.gao.gov/products/GAO-16-195T. Dr. Schwartz testified on the need for certain legislation, H.R. 1362 and H.R. 2151, as described herein. During the hearing the Subcommittee also considered five bills. One of these bills is H.R. 1362, Medicaid REPORTS Act, which would require states to submit annual reports identifying the sources and amounts of funds used by the state to finance the non-federal share of Medicaid. Identified sources required to be reported include a bona fide provider-related donation and donation revenue, a broad-based health care related tax, and an intergovernmental transfer from a unit of local government within the State. A second bill is H.R. 2151, “Improving Oversight and Accountability in Medicaid Non-DSH Supplemental Payments Act.” This legislation would impose reporting and annual auditing requirements on non-disproportionate share hospital (DSH) supplemental payments and clarify payment policies for non-DSH supplemental funding, and require annual independent audits of states’ non-DSH provider payments.
